先说最重要的一点：oiioCare 和小鹦是饮食与情绪的陪伴记录工具，不是医疗服务，不提供诊断、治疗或医疗建议，也不能替代医生、营养师或心理咨询师。如果你出现持续的进食困难、明显的体重变化、催吐或其他让你担心的情况，请及时就医；遇到紧急情况，请立即拨打 120 或当地急救电话；如有伤害自己的想法，也可拨打全国心理援助热线 12356，或联系身边信任的人。

欢迎使用 oiioCare。本条款适用于 oiioCare 网站（oiioCare.com）和 oiioCare App（以下统称「服务」）。使用服务即表示你同意本条款和《隐私政策》。如果你不同意，请不要使用服务。

一、服务是什么

  1. oiioCare 让你用聊天的方式（文字 / 拍照 / 语音）记录吃了什么、想吃什么，以及当时的感受。「想吃」和「已吃」分开记。
  2. AI 陪伴角色「小鹦」会根据你的记录给出陪伴式的回应和回看。小鹦是 AI 程序，不是真人，也不是医疗或心理专业人员。
  3. 未登录时，你可以浏览示例对话；示例只在页面展示，不会写入用户数据库。

二、不是医疗建议

  1. 服务中的任何内容，包括小鹦的回复、回看和统计，仅供你自我记录和参考，不构成医疗、营养、心理或其他专业建议，也不是诊断或治疗。
  2. 请不要因为服务中的内容而推迟就医，或自行停止、更改医生给你的治疗方案。
  3. 如果你正在经历进食障碍、严重的情绪困扰或其他健康风险，请先联系专业人士。服务不用于医疗紧急情况。

三、谁可以使用

  1. 你应年满 14 周岁；如果你所在地法律规定的最低年龄更高，以当地法律为准。
  2. 未满 18 周岁的用户，须在监护人同意下使用。监护人可联系我们协助查阅、删除记录或注销账号，详见《隐私政策》「未成年人」一节。

四、账号

  1. 你可以用邮箱或 Sign in with Apple 登录。Google 登录暂未开放；开放后适用同样的规则。
  2. 请妥善保管你的登录方式，不要与他人共用账号。发现账号被他人使用，请尽快联系我们。
  3. 目前 Web 与 App 账号暂未打通，记录不互通；打通后我们会更新相关说明。

五、你的内容

  1. 你提交的文字、餐图、语音和情绪标签（「你的内容」）归你所有。
  2. 为了向你提供服务（保存、显示、转写、生成小鹦的回应、导出和删除），你授权我们在提供服务所必需的范围内存储和处理你的内容。这项授权不可转让，账号注销或内容删除后即终止，法律要求保留的除外。
  3. 我们不出售你的内容。默认不用于训练 AI 模型；如需用于改进模型，会另行单独征求你的同意，详见《隐私政策》。
  4. 你可以随时修改或删除自己的记录。

六、使用规则

使用服务时，请不要：

  1. 上传违法内容，或侵犯他人隐私、肖像、知识产权的内容；
  2. 未经他人同意记录或上传他人的个人信息；
  3. 尝试访问他人的账号或数据，干扰、攻击、逆向工程服务，或绕过安全措施；
  4. 用自动化方式大量抓取、注册或调用服务；
  5. 把服务用于任何违法用途。

违反这些规则时，我们可以删除相关内容、限制或终止你的账号；情节严重的，可能依法向有关部门报告。

七、AI 输出可能不准确

  1. 小鹦的回复由 AI 自动生成，可能不准确、不完整或不适合你的情况，例如认错食物、估错份量、误解你的情绪。
  2. 请结合自己的判断使用 AI 输出，涉及健康的决定请咨询专业人士。

八、服务的变化与终止

  1. 我们会持续改进服务，可能增加、调整或停止部分功能。影响较大的变化，我们会提前通过本页或产品内通知告诉你。
  2. 如果我们决定停止整个服务，会提前至少 30 天通知，并在停止前提供导出记录的方式。
  3. 你可以随时停止使用服务。

九、注销账号

注销方式、处理时限（15 个工作日内）和会删除哪些数据，见《隐私政策》「注销账号」。

十、免责与责任限制

  1. 我们会尽力保持服务稳定、安全，但服务按「现状」提供，可能因维护、网络或第三方服务故障而中断，我们不保证服务永远不中断、没有错误。
  2. 在法律允许的范围内，对于因使用或无法使用服务而产生的间接损失，我们不承担责任。
  3. 以上内容不排除或限制依照适用法律不能排除或限制的责任，包括因我们的故意或重大过失造成的损失，也不影响你作为消费者依法享有的权利。

十一、iOS App 与 Apple

  1. 通过 App Store 下载的 oiioCare iOS App，同时适用 Apple 的《标准最终用户许可协议》（Standard EULA）和本条款；两者不一致时，就 App 的许可部分以 Apple 标准 EULA 为准。
  2. App 由 oiioCare（个人开发者）提供并负责，Apple 不对 App 及其内容承担责任，也不负责 App 的维护和支持。

十二、适用法律与争议

本条款适用中华人民共和国法律（为本条款之目的，不含港澳台地区法律）。发生争议时，双方先友好协商；协商不成的，任一方可向运营方所在地（四川省成都市）有管辖权的人民法院起诉。这不影响你作为消费者依照你所在地强制性法律享有的权利。

十三、条款更新

我们可能更新本条款，更新后会在本页公布新的生效日期。重大变更会通过产品内通知或弹窗提示。更新生效后继续使用服务，即表示你接受更新后的条款；如果不同意，你可以停止使用并注销账号。

Most important: oiioCare and its AI companion oiio (小鹦) are a food-and-mood journaling companion, not a medical service. They do not provide diagnosis, treatment, or medical advice, and they do not replace a doctor, dietitian, or mental-health professional. If you have ongoing trouble eating, noticeable weight changes, purging, or anything else that worries you, please see a doctor. In an emergency, call your local emergency number right away (120 in mainland China). If you are thinking about harming yourself, you can also call a local crisis line (in mainland China, the national psychological assistance hotline 12356) or reach out to someone you trust.

These terms apply to the oiioCare website (oiioCare.com) and the oiioCare App (together, the "Service"). By using the Service you agree to these terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. What the Service is

  1. oiioCare lets you log what you ate, what you are craving, and how you feel, by chat (text, photo, or voice). Cravings and meals are logged separately.
  2. The AI companion oiio replies to your entries with supportive comments and reviews. oiio is an AI program, not a person, and not a medical or mental-health professional.
  3. Without signing in, you can browse a sample chat; the sample is only shown on the page and is never written to our user database.

2. Not medical advice

  1. Everything in the Service, including oiio's replies, reviews, and stats, is for your own journaling and reference only. It is not medical, nutritional, psychological, or other professional advice, and it is not a diagnosis or treatment.
  2. Do not delay seeking care, or stop or change a treatment your doctor gave you, because of anything in the Service.
  3. If you are dealing with an eating disorder, serious emotional distress, or another health risk, please contact a professional first. The Service is not for medical emergencies.

3. Who can use it

  1. You must be at least 14 years old, or older if the law where you live sets a higher minimum age.
  2. If you are under 18, you need a parent's or guardian's consent. A guardian can contact us for help viewing or deleting entries or deleting the account; see Privacy Policy — Minors.

4. Accounts

  1. You can sign in with email or Sign in with Apple. Google sign-in is not available yet; once it opens, the same rules apply.
  2. Keep your sign-in method safe and do not share your account. If someone else is using your account, contact us as soon as possible.
  3. Web and App accounts are not linked yet, so entries do not carry over between them. We will update this when they are linked.

5. Your content

  1. The text, meal photos, voice, and mood tags you submit ("Your Content") belong to you.
  2. To provide the Service (storing, displaying, transcribing, generating oiio's replies, exporting, and deleting), you allow us to store and process Your Content only as needed to provide the Service. This permission is non-transferable and ends when you delete the content or your account, except where the law requires us to keep it.
  3. We do not sell Your Content. By default it is not used to train AI models; if we ever want to use it to improve models, we will ask for your separate consent first. See the Privacy Policy.
  4. You can edit or delete your entries at any time.

6. Acceptable use

When using the Service, please do not:

  1. upload illegal content, or content that infringes others' privacy, image rights, or intellectual property;
  2. log or upload other people's personal information without their consent;
  3. try to access other people's accounts or data, interfere with, attack, or reverse-engineer the Service, or bypass its security;
  4. scrape, register, or call the Service in bulk by automated means;
  5. use the Service for anything illegal.

If these rules are broken, we may remove the content and restrict or close the account, and in serious cases report it to the authorities as the law requires.

7. AI output may be wrong

  1. oiio's replies are generated automatically by AI and may be inaccurate, incomplete, or not right for your situation. For example, it may misidentify food, misjudge portions, or misread your mood.
  2. Use your own judgment with AI output, and ask a professional about health decisions.

8. Changes to the Service and termination

  1. We keep improving the Service and may add, change, or remove features. We will tell you in advance on this page or in the product about changes with a significant impact.
  2. If we decide to shut down the whole Service, we will give at least 30 days' notice and offer a way to export your entries first.
  3. You can stop using the Service at any time.

9. Deleting your account

How to delete your account, the processing time (within 15 business days), and what gets deleted are described in Privacy Policy — Delete account.

10. Disclaimer and limitation of liability

  1. We work to keep the Service stable and secure, but it is provided "as is" and may be interrupted by maintenance, network issues, or third-party outages. We do not promise it will always be uninterrupted or error-free.
  2. To the extent the law allows, we are not liable for indirect losses arising from using or being unable to use the Service.
  3. Nothing here excludes or limits liability that cannot be excluded or limited under applicable law, including losses caused by our intentional misconduct or gross negligence, and nothing affects your statutory rights as a consumer.

11. iOS App and Apple

  1. The oiioCare iOS App downloaded from the App Store is subject to both Apple's Licensed Application End User License Agreement (Standard EULA) and these terms. Where they conflict about the license to the App, Apple's Standard EULA governs.
  2. The App is provided by, and is the responsibility of, oiioCare (individual developer). Apple is not responsible for the App or its content, or for its maintenance and support.

12. Governing law and disputes

These terms are governed by the laws of the People's Republic of China (for these terms, excluding the laws of Hong Kong, Macao, and Taiwan). We will first try to resolve any dispute through good-faith discussion; if that fails, either party may bring the dispute to a competent people's court where the operator is located (Chengdu, Sichuan). This does not affect any rights you have as a consumer under the mandatory laws of where you live.

13. Changes to these terms

We may update these terms and will post the new effective date on this page. Significant changes will be announced in the product or by a pop-up. If you keep using the Service after an update takes effect, you accept the updated terms; if you do not agree, you can stop using the Service and delete your account.
